GetBiz Campaigns — Terms of Service

1. Agreement

These Terms are a binding agreement between you (and the organization you represent) and GetBiz Solutions. By creating an account or using GetBiz Campaigns, you agree to these Terms. If you act on behalf of an organization, you confirm you are authorized to bind it.

2. What GetBiz Campaigns does

GetBiz Campaigns lets you build contact lists, create and send email campaigns and automations, and measure results. Sending is performed through the email provider you configure. Available features depend on your plan.

3. Accounts and eligibility

You must provide accurate information, keep credentials secure, and be legally able to enter into these Terms. You are responsible for all activity under your account and for users you invite.

4. Consent, anti-spam, and your responsibilities

You represent and agree that you will:

• email only recipients for whom you have a lawful basis/consent, and never send unsolicited bulk email (spam);
• include a functioning unsubscribe mechanism and, where required, your physical mailing address, in every campaign;
• honor unsubscribe and opt-out requests promptly;
• comply with anti-spam and data-protection laws (for example CAN-SPAM, CASL, GDPR, and India’s DPDP Act), and not send prohibited, deceptive, infringing, or harmful content;
• not import purchased, scraped, or harvested lists, or send to recipients who have unsubscribed.

We may suspend or terminate accounts, and sending providers may block mail, for high complaint/bounce rates or policy violations, to protect deliverability and recipients.

5. Email sending providers & integrations

GetBiz Campaigns sends through the provider you configure (for example Amazon SES, SMTP, SendGrid, Mailgun, Elastic Email, SparkPost, Postmark, or Gmail), and can connect optional services such as Google/Facebook sign-in, Google reCAPTCHA, AI content tools, payment, webhooks, and automation connectors. Your use of each is governed by that provider’s terms, and you are responsible for the accounts and credentials you connect.

6. Content and responsibilities

You retain ownership of your contact lists and content. You grant us a limited license to host, process, and transmit them solely to provide the Service. You are responsible for the accuracy, legality, and your right to use the data, and for your campaigns’ content.

7. Plans, fees, and billing

Paid plans are billed in advance on the cycle shown at purchase; fees are non-refundable except where required by law or expressly stated. Any charges from your chosen email-sending provider are separate and your responsibility. Taxes are your responsibility unless stated otherwise.

8. Service availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may add, modify, or discontinue features.

9. Intellectual property

GetBiz Campaigns, including its software, design, and trademarks, is owned by GetBiz Solutions and its licensors. These Terms grant you only a limited, non-exclusive, non-transferable right to use the Service.

10. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied. We do not guarantee inbox placement or deliverability, which depend on your practices and third-party providers.

11. Limitation of liability

To the maximum extent permitted by law, GetBiz will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the 12 months before the event giving rise to the claim.

12. Indemnification

You will defend and indemnify GetBiz against claims arising from your contact lists, your campaigns, your lack of consent, your use of the Service, or your breach of these Terms or anti-spam laws, except to the extent caused by us.

13. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access for breach, non-payment, spam/abuse, or legal reasons. On termination, you may request export or deletion of data as described in our Data Deletion process, subject to legal retention requirements.

14. Governing law

These Terms are governed by the laws of India, and the courts of Surat, Gujarat will have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date. Continued use after changes take effect means you accept the updated Terms.
