Terms of Service

1. Acceptance of terms

By accessing or using the Services, or by clicking “I agree,” you accept these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use the Services. If you are entering into these Terms for an organization, you confirm you are authorized to bind it.

2. Definitions

• “Customer,” “you” — the organization or individual using the Services.
• “Users” — people you authorize to use the Services under your account.
• “Customer Data” — content you or your Users submit to the Services (e.g. employee records, contact lists, posts, CRM data).

3. Description of the Services

GetBiz provides cloud business software, which may include:

• GetBiz HRMS — employee, attendance, leave, and payroll management.
• GetBiz Social — scheduling, publishing, and analytics for connected social accounts.
• GetBiz Email Campaign — email marketing, automation, and list management.
• GetBiz CRM and other products, features, and integrations we make available.

We may add, change, or discontinue features. We will give reasonable notice of material changes that adversely affect your use.

4. Accounts and eligibility

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be legally able to enter into these Terms and use the Services for lawful business purposes only.

5. Subscriptions, trials, and billing

• Paid plans are billed in advance on the cycle shown at purchase. Fees are non-refundable except where required by law or expressly stated.
• Free trials, if offered, convert to a paid plan unless cancelled before the trial ends.
• We may change pricing with prior notice effective at your next renewal.
• Taxes are your responsibility unless stated otherwise.

6. Acceptable use

You agree not to, and not to allow anyone to:

• Use the Services to break any law or infringe others’ rights.
• Upload malware, attempt to breach security, or disrupt the Services.
• Reverse engineer, resell, or copy the Services without permission.
• Email Campaign: send unsolicited bulk email (spam). You must have a lawful basis and recipient consent, honor opt-outs and unsubscribe requests promptly, and comply with anti-spam laws (e.g. CAN-SPAM, GDPR, and India’s applicable regulations).
• Social: comply with each connected platform’s terms, automation limits, and content policies.
• HRMS: process employee and payroll data only with a lawful basis and appropriate notices to your staff.

We may suspend or limit accounts that violate this section or create risk to the Services or others.

7. Customer Data and responsibilities

You retain ownership of your Customer Data. You grant us a limited license to host, process, and transmit it solely to provide and support the Services. You are responsible for the accuracy, legality, and your right to use the Customer Data, and for obtaining any required consents from the individuals it concerns. Our handling of personal data is described in our Privacy Policy.

8. Intellectual property

The Services, including all software, design, and content we provide, are owned by GetBiz and its licensors and protected by law. Except for the rights expressly granted to you, we reserve all rights. Feedback you provide may be used by us without obligation to you.

9. Third-party services

The Services may integrate with third-party platforms and tools. Your use of those is governed by their terms, and we are not responsible for third-party services. Connecting or disconnecting them is your choice.

10. Availability and support

We aim to keep the Services available and reliable but do not guarantee uninterrupted operation. Planned maintenance, updates, or factors beyond our control may cause downtime. Support is provided per your plan.

11. Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, GetBiz will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services will not exceed the amounts you paid to us for the Services in the 12 months before the event giving rise to the claim.

13. Indemnification

You will defend and indemnify GetBiz against claims arising from your Customer Data, your use of the Services, or your breach of these Terms, except to the extent caused by us.

14. Term and termination

These Terms apply while you use the Services. You may stop using the Services and cancel at any time. We may suspend or terminate access for breach, non-payment, or legal reasons. On termination, your right to use the Services ends; you may request export or deletion of Customer Data as described in our Data Deletion process, subject to legal retention requirements.

15. Governing law

These Terms are governed by the laws of India, and the courts of Surat, Gujarat will have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date. Continued use after changes take effect means you accept the updated Terms.
